1. Acceptance of Terms
1.1. Thank you for visiting the websites ("Websites" and collectively with the Mobile Application and Social Media, the "Sites" or the "Site") operated by or on behalf of the Colorado Lottery (therein referred to as "we" or "us" or "Colorado Lottery"). By accessing and using the Sites, you acknowledge that you have read and agree to be bound by these Terms of Service (“TOS”), including the Lottery’s Privacy Policy (link). If you do not agree to be bound by these TOS or are not eligible to use the Sites, please exit the Site immediately and refrain from using it.
1.2. You must be at least 18 years of age to use the Sites.
1.3. When you participate in any of the Colorado Lottery’s “Activities” (not limited to Bonus Draws, quizzes, contests, and/or promotions), you agree that you fully understand and comply with these TOS.
1.4. We can change or update these TOS at any time without notifying you, and such changes or updates will be effective immediately upon posting. If you continue to use the Sites after such changes or updates are posted, you will be deemed to agree to such changes or updates. Please review the Site and these Terms of Service periodically for changes and updates.
1.5. The Colorado Lottery reserves the right to modify or discontinue the Colorado Lottery Sites for any reason without notice.
2. Use of Sites
2.1. You must be at least 18 years of age to use the Sites.
2.2. Colorado Lottery makes every effort to ensure that all information provided in its Sites is accurate and timely. In the event there is a discrepancy between the information provided in these Sites and the information available on the official Terminal at a retail location, the information at the Terminal at the retail location is deemed official.
2.3. By submitting information to register for a MyLottery Account, or to update your existing account profile, you represent and warrant that:
2.3.1. You are registering for an account or updating your existing account profile in your own name;
2.3.2. You are using your own personal information;
2.3.3. The information you provide is true, complete, and accurate to the best of your knowledge; and
2.3.4. You are not prohibited from gambling or otherwise using this website.
2.4. Employees of the Colorado Lottery, independent auditing firms, major contractors/vendors, Lottery Commission, and members of their immediate families are not eligible to participate in Activities.
2.5. During the registration process, you are required to create a password. You acknowledge and agree that we may rely on this password to identify you. You are entirely responsible for maintaining the confidentiality of your password and account and for any and all Activities that occur under your account, regardless of whether you authorized such access or use.
2.5.1. You agree to (a) immediately notify us of any unauthorized use of your account or any other breach of security of which you become aware, and (b) logout completely from your account at the end of each online session.
2.6. Individuals who represent that they are at least 18 years of age may submit a request to receive emails and newsletters by providing their name, email address, and other information to the Lottery.
2.6.1. The Lottery does not warrant the accuracy, completeness, or reliability of the information in any email or newsletter provided by the Lottery, and disclaims all liability that results from the use of any such information. Every reasonable effort is made to ensure that the information provided is accurate. However, in the event of an error, the winning numbers and prize amounts in the official records of the Lottery will prevail.
2.7. It is your responsibility to ensure that you understand the Guidelines for Activities posted at coloradolottery.com before you participate in Activities. Any participation in Activities is at your sole option, discretion, and risk.
2.8. The Colorado Lottery Mobile App utilizes barcode technology to determine whether a Colorado Lottery ticket is a winner, non-winner, and/or eligible for a Bonus Draw.
2.8.1. The Colorado Lottery is not liable for a Player’s computer or device, including but not limited to scan errors, malfunctions, or attempts to participate in Activities by methods other than those designated by the Colorado Lottery in the Activities’ Guidelines.
2.8.2. In the event that misinformation or an error occurs, the entry recorded in the Colorado Lottery’s database shall be deemed official, and the Colorado Lottery shall not be held responsible.
2.9. By participating in Activities, you agree that you meet the following:
2.9.1. You are not restricted by limited legal capacity;
2.9.2. You are not classified as a compulsive gambler;
2.10. Access to the Sites may from time to time be unavailable, delayed, limited, or slowed due to, but not limited to, the following:
2.11. Scheduled daily maintenance;
2.12. Emergency (unscheduled) maintenance;
2.13. Hardware failure, including but not limited to failures of computers (including your own computer), servers, networks, connections, and other electronic and mechanical equipment;
2.14. Software failure, including but not limited to bugs, errors, viruses, configuration problems, incompatibility of systems, utilities, or applications, the operation of firewalls or screening programs, unreadable codes, or irregularities within particular documents or other content;
2.15. Overload of system capacities;
2.16. Damage caused by severe weather, earthquakes, acts of God, accidents, fire, water damage, explosion, mechanical breakdown, or natural disasters;
2.17. Interruption (whether partial or total) of power supplies or other utility or service (including the Internet); or
2.18. Other similar disruptions.
3. Prohibitive Uses
In connection with your use of the Site, you agree you will use the Site only for the personal use for which it was intended, and you will not:
3.1. Use the Site for any unlawful, unauthorized, fraudulent, or malicious purpose.
3.2. Misrepresent your identity or personal information, create a false identity to mislead others, or impersonate any person.
3.3. Allow any other person to use your MyLottery Account.
3.4. Impersonate any other person, business, entity, physical location, or IP address.
3.5. Register, subscribe, attempt to register, attempt to subscribe, unsubscribe, or attempt to unsubscribe any party for any services if you are not expressly authorized by such party to do so.
3.6. Access or circumvent any of our security measures.
3.7. Probe, scan, or test the vulnerability of or breach the authentication measures of this Site or any related networks or systems.
3.8. Upload files containing malware, including but not limited to viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or similar software or programs.
3.9. Violate any local, state, national, or international law or court order or the Rules and Regulations of the Colorado Lottery.
3.10. Harvest or otherwise collect information about others, including email addresses, or gain unauthorized access to any other accounts, computer systems, or networks.
3.11. Use any robot, spider, scraper, or other automated or manual means to access this Site or its data.
3.12. Modify, adapt, sublicense, translate, sell, reverse engineer, decompile, or disassemble any portion of the Site.
3.13. Users may be blocked and/or their comment deleted from any Colorado Lottery social media page or any user-generated content on the website for any reason, including the following:
3.13.1. Profanity
3.13.2. Bullying/harassment
3.13.3. Reaching out to other accounts
3.13.4. Spreading misinformation about the Colorado Lottery, its games, or promotions
3.13.5. Promoting or denigrating a political party or politician
We reserve the right to take whatever lawful actions we may deem appropriate (whether at law or in equity) in response to actual or suspected violations of the foregoing, including, without limitation, the suspension or termination of the user's access and/or account. The Colorado Lottery will cooperate fully with any law enforcement officials and/or agencies if requested or required in the investigation of any users who violate the Terms of Service and may disclose your information to such law enforcement officials and/or agencies as may be required by law.
4. Links to Third-Party Offerings
These Sites may contain information and links to other sites and offerings owned, operated or provided by parties other than us. Such information, links, and access are provided only for reference, ease of use, and/or your consideration. We may remove a link at any time at our sole discretion for any reason whatsoever. We do not control such third-party products, websites, or offerings, and we are not responsible or liable for their terms of use, privacy practices, or operation, content, or accuracy. We do not endorse these sites, products, or the content or services provided there. We accept no liability for any information, products, advertisements, content, services, or software accessible through these third-party offerings, for business and/or privacy practices of any third-party, for any action you may take or for any damages or losses you may incur as a result of linking to any such offering. Any opinions, statements, services, or other information expressed or made available by users or third-party suppliers on this Site are solely those of such users or third-party providers.
5. Indemnification
You agree to indemnify and hold harmless the Colorado Lottery, our members, affiliates, providers, partners (and each of their respective successors and assigns) and the officers, directors, partners, shareholders, agents, licensees, and employees of each of the foregoing from and against all claims, actions, liabilities, losses, expenses, damages and costs, including but not limited to attorney's fees, that may, at any time, arise out of or relate to your authorized, unauthorized, lawful or unlawful use of the Site, any Product or Content, your breach of these Terms of Use, your inability to access the Site or any Products available on or through the Site, the use of any linked websites, your reliance on any errors or omissions on the Site, or the propagation and/or contraction of any computer virus in connection with your use of the Site, Products, and/or the Content.
6. Claiming Prizes
Subject to these terms and conditions and all applicable state and federal law, prizes eligible for claim through the Services are as follows:
● Prizes of $600 up to and including $5,000 may be claimed through the CO Connected Play app
● Prizes of $1 - $599 may be claimed at a retailer location, via mail-in claim, or in person at a Colorado Lottery claim center. Prizes of any value can be claimed in person at a Colorado Lottery claim center.
Before payment of any prize, we may require you to provide additional information, provide copies of documents, or appear in person at a designated claim center. We may change available methods for claiming a prize at any time and without notice. If we suspect any unlawful conduct or violation of these terms, we may withhold payment of a prize pending completion of an investigation. You agree to cooperate with us in any investigation. We do not guarantee payment of a prize within any specific period of time. We are not liable for any damages or losses resulting from any delay in payment of a prize.
7. CLAIM FORM
You will be required to complete an online claim form for any prize of $600 to $5,000; prizes $5001 and higher must be claimed at a Colorado Lottery claim center in person. By checking the boxes on the form, you represent and warrant that: (i) you are the registered user of the CO Connected Play Account; (ii) your CO Connected Play Account information is accurate; and (iii). You accept the Colorado Lottery claim policy and procedures. In addition, you have read, understand, and certify the following:
● The Federal Privacy Act (Public Law 93-579), 5 U.S.C. §552a, requires this notice when personal information is collected from individuals.
● Information is collected to validate and process a claim and for promotional, investigative, and administrative purposes. By my signature hereto, I indemnify the Colorado Lottery for any loss which may result if any of the foregoing information is not true and accurate. I understand that the Colorado Lottery is a state agency and, therefore, my name, city of residence, and prize amount are public records and may be made available for public information. The Colorado Lottery will post my first name, the first initial of my last name, hometown, the prize amount won, and the game I played on the Colorado Lottery's website.
● You understand that the Colorado Lottery, its retailers and advertising agencies, and the news media may use your name, likeness, and statements for reproduction as it relates to winner awareness for purposes of advertising, promotion, display, or exhibition. Further, you understand that you may be asked to participate in interviews with the Colorado Lottery public relations personnel.
● Under penalty of perjury, you certify that the taxpayer identification number shown on this form correctly identifies the recipient of this payment, the owner of this CO Connected Play account, that you are a U.S. citizen or legal U.S. resident, and you are not subject to backup withholdings (if applicable). The Internal Revenue Service does not require your consent to any provision of this document other than the certifications required to avoid backup withholding.
● PRIVACY NOTICE ACT: *SOCIAL SECURITY NUMBER REQUIRED if the amount of any one prize is $600 or more. If you do not provide the Lottery with a tax Identification number and elect not to report your residency status, your prize will be subject to the Internal Revenue Service non-resident withholding requirements. Disclosure of your social security number IS required for tax reporting and withholding purposes, pursuant to 42 U.S.C. § 405(c) (2) (C), 26 U.S.C. § 3402 (q), 26 U.S.C. § 6041, and § 39-22-604, C.R.S.
● Colorado law also requires the Lottery to check social security numbers for the purpose of enforcing state lottery winning offsets, including those related to child support, obligations identified by the judicial department, and certain state debts. § 44-40-113, -114, C.R.S. If YOU are in arrears, the Lottery is required to withhold the amount in arrears or the entire prize, whichever is less.
● All prizes must be claimed as stated by the rules and guidelines for the game. No payments will be made for expired, damaged, mutilated, stolen, or tickets that cannot be validated by the service.
● Lottery claims cannot be based on errors, whether human or electronic, in how information is recorded, shown, or shared. This includes any errors in data displayed on screens, printed materials, websites, or through any means. Claims cannot be based on any communication or transmission, intentional or accidental, that was not officially authorized by the Colorado Lottery. The Colorado Lottery is not responsible for damages or losses caused by incorrect or unauthorized information, displays, or data transmissions.
Under penalty of perjury, I declare that to the best of my knowledge and belief (A) the name, address, and taxpayer identifying number, which I have furnished, correctly identify me as the recipient of payment, and (B) I am not a person disqualified by statute or regulation from claiming and/or accepting a prize from the Lottery.
You understand and agree that checking the box constitutes your electronic signature in agreement with the above terms.
Foreign Account Tax Compliance Act (FATCA). The FATCA requires US taxpayers to report certain foreign financial accounts and offshore assets. It also requires certain foreign financial institutions to report all US account holders who are specified US persons. To learn if You own foreign financial assets subject to the FATCA or if You qualify for an exemption from the FATCA, please refer to the IRS website at www.irs.gov. Withholding is the cost of not reporting.
