The Colorado Lottery is committed to protecting your privacy. This Privacy Policy describes our practices regarding information collected from users through our website, through our loyalty program known as MyLottery, through participation in our games and contests, and through our Mobile App (collectively “Services”)..

We fully support the protection of individual privacy and minimize the collection of personally identifiable information to the least amount of information required to complete a particular transaction. This Privacy Policy extends to the collection of all personally identifiable information, regardless of the source or the medium.

You may access, correct, or delete your personal information; as well as opt out of the collection of your information.  If you choose to do so, you will not be able to use all of the Services.

By using these Services, you represent that you understand and agree to this Privacy Policy. Any updates to this Privacy Policy will be posted in the form of an announcement on the homepage of the website at coloradolottery.com.

 

Collection and Use of General Information

Cookies

When you use our website or Mobile App, we may automatically collect and store certain information about your visit. This information does not identify you personally and includes the following:

●      The type of browser and operating system used to access our site;

●      The date and time you access our site;

●      The pages you visit;

●      The web address from which you linked to our website;

●      The geographic location of your IP address or mobile device; and

How We Use the General Information We Collect

We may use the information to analyze trends, administer the website, improve site performance, and gather broad demographic information. We use this information only in aggregate form and may disclose it to third parties who help us maintain and improve our Services.

Collection and Use of Personally Identifiable Information

We collect personally identifiable information (“PII”) to permit players to participate in the MyLottery loyalty program, to enter players into Jackpot and Scratch Bonus Draws and Contests, to conduct surveys, to permit players to claim prizes, to communicate with you, and to provide customer service.

We may require the following PII from you when you sign up to become a MyLottery member, or when you participate in Bonus Draws, claim prizes, or complete surveys.

How We Use the PII We Collect

When you voluntarily provide information to the Colorado Lottery, you are authorizing us (and any vendors we expressly authorized) to use, transmit, disclose, and store such information for all purposes necessary to consummate the transactions you have requested.

We will not sell any information collected from users of the Services and will ensure that any data provided to third parties, as set forth below under Sharing of Information, is used consistently with this Privacy Policy and applicable laws.

We collect citizenship information for tax purposes only and will not share it for any other reason.

The Colorado Lottery’s games, contests, and Services are not directed at minors. We do not knowingly collect personal information from anyone under the age of 18, and no part of the Services is designed to attract anyone under the age of 18.

We may use information about you for various reasons, including, but not limited to:

●      Send you notices, updates, and alerts;

●      Provide and deliver the products and services you request, process transactions, and send you related information, including confirmations, receipts, and educational materials;

●      Monitor usage trends and activities in connection with your use of the Services;

●      Communicate about Colorado Lottery products, services, offers, promotions, and rewards;

●      Personalize the Services, including advertisements, content, or features we and/or our third parties think will be of interest to you;

●      Facilitate contests and promotions; and

●      Carry out other purposes described at the time the information is collected.

Winners’ Information

We require players to provide PII for the purpose of entering Bonus Draws and Contests. This information is maintained in a secure database and is used for the purpose of conducting random drawings to select winners and alternate winners. The information submitted via our website or Mobile App is used to validate the winning entry with the identity of the player who submitted the entry. Once an entry has been submitted by a player, the information cannot be altered.

The first name, the first initial of the last name,  the city of residence, and the amount won by winners may be posted on our website or Mobile App, and your participation in any Colorado Lottery Jackpot, Scratch game or Bonus Draw and/or Contest promotion is a voluntary waiver of any confidentiality rights. Do not participate in any Bonus Draw/Contest promotions if you wish to keep this information confidential.

Surveys

We may conduct voluntary surveys and collect general demographic information to better understand and serve our players. Surveys may be conducted through a survey page on the Website or by a third party hired to conduct surveys on the Lottery’s behalf. If a third party is contracted to conduct a survey on the Lottery’s behalf, your contact information will be disclosed to that third party only for the limited purpose of conducting the survey.

Customer Service

If you submit a request or an inquiry via an online form, email, or telephone call, we may use the information collected, such as your name, address, telephone number, or email address, to respond to your inquiry.

 

Investigations

We may use information collected to conduct internal investigations. We may disclose information to cooperate with an investigation by law enforcement agencies or other governmental authorities or in response to a subpoena, warrant, court order, or other comparable legal process.

Sharing of Information

We may share information about you as described in this Privacy Policy, including:

●      With our contractors, sub-contractors, affiliates, and other third parties for Colorado Lottery marketing purposes, only;

●      With vendors and other service providers who need access to information in connection with services they perform for us;

●      In response to a request for information on whether disclosure is required by any applicable law, regulation, or legal process;

●      If we believe your actions are inconsistent with our user agreements or policies, or to protect the rights, property, and safety of the Lottery or others.

●      With your express consent or at your direction.

We will not sell any information collected from users of the Services and will ensure that any data provided to third parties, is used consistently with this Privacy Policy.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.    

Security Methods

We and our vendors have taken several steps to safeguard the integrity of their computer systems and networks, including, but not limited to, individual authentication, encryption of transmitted data, security monitoring, and auditing. Security methods and measures have been integrated into the design, implementation, and day-to-day practices of the entire digital ecosystem.

Linked Sites

Our website has links to other websites not controlled by the Lottery. When you link to any third-party website, you are subject to the privacy policy of that site. This includes links to sites that are related to the Lottery, such as a link to resources for problem gambling provided by third parties who have an agreement with us to administer such services on our behalf.

The Colorado Lottery is subject to open records laws

The Colorado Open Records Act (“CORA”), §§ 24-72-201 et seq., C.R.S., provides that all public records shall be open for inspection by any person at reasonable times, except as otherwise provided by law.

CORA applies to the information we collect from you. Unless it is protected by state or federal law, the information you provide to us may become a public record and may be subject to public inspection through a CORA request. This includes information you provide if you submit a CORA request to us. CDHE keeps confidential all information protected by state and federal law when responding to CORA requests.

Users are cautioned that the collection of Personal Information that may be provided by or about children will be treated the same as information provided by an adult and may be subject to public access.
