Rule-Making Process
Rulemaking is the formal process by which state agencies create regulations (rules) to implement and interpret statutes consistent with rulemaking authority provided to them by the Colorado General Assembly. The Lottery Commission has the authority to promulgate rules and amend existing rules related to the sale of Lottery products and the operation of the Lottery pursuant to C.R.S. 44-40-109. Rulemaking must comply with the Colorado Administrative Procedures Act.
New rules and amended rules become effective once they are published in the Colorado Register after they have been adopted by the Lottery Commission. More information regarding the rulemaking process can be found on the Secretary of State’s website and the Department of Revenue's website.

Upcoming Rule-Making
Details on upcoming rulemaking can be found on the Secretary of State's website. A rulemaking hearing is scheduled for July 8th, 2026, during the regularly scheduled Colorado Lottery Commission meeting.
Rule changes for consideration: Rule 14.G (Millionaire for Life®) Realignment: This amendment updates the "incorporation by reference" date of the Multi-State Lottery Association (MUSL) Official Game Rules from May 30, 2025, to January 13, 2026. This date advancement is legally required to capture essential operational and prize-tier shifts to maintain multi-state consistency. Redefining Prize Level Combinations: The rule revision modifies how players qualify for the bottom two prize levels (the Eighth and Ninth Tiers) to reflect updated MUSL probability distributions. Second-Level Prize Liability Containment: The amendment incorporates a revised grand-tier liability control structure—effective September 1, 2026—that establishes an equal pari-mutuel lump-sum cash split capped at $15,000,000 if eight (8) or more winning plays are validated nationwide. The update corrects numbering to align with the renumbered and expanded 14-page multi-state document (shifting Matches to Section 15, Liability to Section 16, and Life Annuity Restrictions to Section 17). Rule 14.E - Lucky for Life - Formal Repeal of Retired Game Lucky for Life, which has been permanently retired.
